Terms of Service

These Terms govern your use of SmartIncomeSites.com and any services you purchase from SmartIncomeSites.com, a division of NX Level Marketing LLC (“we,” “us”). By using this site or buying a plan, you agree to them.

We design and build lead-generation websites and conversion tools (quizzes, AI chat and voice concierges, booking flows, exit-intent recovery, local SEO pages, CRM integration). The exact deliverables are those listed for the tier you purchase or stated in your written proposal. Timelines such as our 7-day launch begin once we receive your content, access, and approvals, and depend on your timely responses.

We do not host your domain. Your domain and hosting remain with the registrar or host of your choosing, in your name and under your control. We deploy and maintain your site on that environment. You are responsible for the fees, availability, and terms of your chosen registrar and host, and for providing us the access needed to deploy and maintain the site. We are not liable for outages or losses caused by third-party providers.

Every build includes a required monthly plan ($97, $197, or $297 per month depending on tier). It covers ongoing maintenance, local SEO work, and software updates — including security patches, framework and plugin updates, AI concierge retraining, quiz and copy tweaks, uptime and form/booking monitoring, backups, monthly reporting, and small content edits. It does not include new pages, redesigns, ad spend, or third-party fees unless stated. It begins at launch, bills monthly in advance, and requires a 30-day written notice to cancel; cancellation ends maintenance, SEO, AI concierge, and update services going forward, and hosted features such as the AI concierge, booking flow, and lead routing will be deactivated.

Build fees are due before launch unless otherwise agreed. Financing (Klarna, Affirm, Afterpay) is offered by Stripe and its partners under their own terms; approval and rates are theirs, not ours. Build fees are non-refundable once design or development work has begun. Overdue accounts may have services paused.

On full payment of the build fee, you own your domain, your content, and the finished site pages we deliver. We retain ownership of our underlying frameworks, templates, code libraries, and tooling, and grant you a license to use them as part of your site. We may reference the finished site in our portfolio unless you ask us in writing not to.

You are responsible for the accuracy and legality of the content, claims, offers, and disclosures you provide, and for complying with the laws that govern your industry and your marketing — including TCPA, CAN-SPAM, and advertising rules.

Calculators, projections, and examples on this site are estimates for illustration only. We do not guarantee any specific number of leads, rankings, conversions, or revenue.

To the fullest extent permitted by law, our total liability for any claim is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits.

Either party may end an ongoing plan with written notice. We may update these Terms; continued use of the site or services after an update means you accept the revised Terms.
